AN ORDINANCE CREATING A CITY OR MUNICIPAL BIODIVERSITY MANAGEMENT OFFICE (BMO)

WHEREAS the Constitution of the Republic of the Philippines mandates the protection and advancement of the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.

WHEREAS, the Department of Environment and Natural Resources (DENR), through its Biodiversity Management Bureau (BMB), is tasked with the conservation, preservation, and management of the country's biodiversity.

WHEREAS it is necessary for local government units (LGUs) to establish their own Biodiversity Management Offices (BMO) to act as the local counterpart of the BMB, focusing on the protection, preservation, and rewilding of endemic and native species within their jurisdiction.

NOW, THEREFORE, be it ordained by the Sangguniang Bayan/Panlungsod of __________, in session duly assembled, that:

SECTION 1. TITLE

This ordinance shall be known as the "City/Municipal Biodiversity Management Office Ordinance of __________."

SECTION 2. CREATION OF THE BIODIVERSITY MANAGEMENT OFFICE

There is hereby created a City/Municipal Biodiversity Management Office (BMO), which shall serve as the local counterpart and partner of the Biodiversity Management Bureau (BMB) under the DENR.

SECTION 3. OBJECTIVES

The BMO shall have the following objectives:

1.   To conserve, preserve, and rewild endemic and native species of flora and fauna within the city/municipality.

2.   To restore ecosystems and natural habitats through sustainable and science-based rewilding efforts.

3.   To ensure the protection of biodiversity, with clear targets set for the number of species to be conserved, preserved, or rewilded annually.

4.   To collaborate with relevant government agencies, academic institutions, non-governmental organizations (NGOs), and other stakeholders.

SECTION 4. SCOPE AND FUNCTIONS

The BMO shall be responsible for the following:

1.   Monitoring, documenting, and protecting endemic and native species of flora and fauna within the city/municipality.

2.   Implementing conservation, preservation, and rewilding programs in coordination with the BMB.

3.   Conducting environmental education and public awareness campaigns.

4.   Collaborating with the BMB, NGOs, local chapters of wildlife conservation organizations, and state universities and colleges involved in biodiversity management.

5.   Preparing an annual biodiversity management report to be submitted to the Sangguniang Bayan/Panlungsod.

SECTION 5. PARTNERSHIPS AND COORDINATION

The BMO shall closely cooperate with the following institutions:

1.   Biodiversity Management Bureau (BMB) of the DENR.

2.   Philippine Coast Guard, BFAR, and SEAFDEC for marine biodiversity.

3.   UPLB, Bureau of Plant Industry (BPI), and FPRDI for flora conservation.

4.   NGOs such as WWF and the Center for Conservation Innovations PH, Inc.

5.   Local academic institutions for research collaboration.

6.   DILG, DOST, and other relevant agencies for assistance in species identification, rewilding, and transportation of wildlife.

SECTION 6. PROHIBITION OF NON-NATIVE SPECIES INTRODUCTION

No species of flora or fauna that are not native or endemic to the city/municipality shall be introduced into the wild. The BMO shall coordinate with the DOST to ensure accurate species identification and genetic purity before rewilding.

SECTION 7. HEALTH AND SAFETY MEASURES

1.   The BMO shall ensure that no contaminated or disease-carrying species are rewilded.

2.   The city or municipality shall provide funds to support the BMO with veterinarians and necessary veterinary supplies.

3.   The city or municipal veterinarian may be assigned additional responsibilities within the BMO, with appropriate compensation.

SECTION 8. FUNDING

The city/municipality shall allocate funds for the establishment and operation of the BMO. Additional funding may be sourced through partnerships with NGOs, private sector sponsors, and grants.

SECTION 9. EFFECTIVITY

This Ordinance shall take effect immediately upon approval and publication as required by law.
