AN ORDINANCE ESTABLISHING THE CREATION OF
MAN-MADE LAKES IN BARANGAYS FOR FLOOD CONTROL, WATER SECURITY, FOOD SECURITY,
AND OTHER COMMUNITY BENEFITS
Be it ordained by the Sangguniang
Bayan/Sangguniang Panlungsod of ___________, in session assembled:
SECTION 1. TITLE This ordinance shall be known as the "Barangay Man-Made Lakes
Development Ordinance."
SECTION 2. PURPOSE The purpose of this ordinance is to establish and maintain man-made
lakes within the jurisdiction of the municipality/city to achieve the following
objectives:
1.
Flood control and water management
2.
Water security and rainwater storage
3.
Food security through aquaculture and water
vegetable farming
4.
Livelihood generation and community
participation
5.
Climate change adaptation and mitigation
6.
Recreation, tourism, and environmental
conservation
SECTION 3. SCOPE AND COVERAGE This ordinance shall apply to all barangays within the territorial
jurisdiction of ___________, subject to land availability and suitability for
man-made lake development.
SECTION 4. FUNDING The funds for the creation of man-made lakes shall be 100% locally
sourced from the following means:
1.
Appropriations from the municipal or city
government budget.
2.
Voluntary contributions from local businesses
as part of their Corporate Social Responsibility (CSR) programs.
3.
Donations and grants from Non-Governmental
Organizations (NGOs), Civil Society Organizations (CSOs), and People’s
Organizations (POs).
4.
Cooperative investments through partnerships.
5.
Community fundraising initiatives.
SECTION 5. COMMUNITY PARTICIPATION The following groups and individuals are encouraged to participate in
the planning, development, and maintenance of the man-made lakes:
1.
Local NGOs, CSOs, and POs
2.
Students for National Service Training Program
(NSTP) credit
3.
TESDA students as part of the Dual Training
System (DTS)
4.
Law offenders assigned to community service by
judicial order
5.
Residents through volunteer programs
SECTION 6. MANAGEMENT AND OPERATIONS
1.
Man-made lakes may be owned and operated by
the Local Government Unit (LGU).
2.
The LGU may enter into agreements with NGOs,
cooperatives, or private management companies for the operation and maintenance
of the lakes, subject to the approval of the Sangguniang Bayan/Panlungsod.
SECTION 7. UTILIZATION AND BENEFITS
1.
The primary function of the man-made lakes
shall be flood control and water security.
2.
Secondary uses may include, but are not
limited to A. Aquaculture for fish farming B. Cultivation of water vegetables C.
Community recreation and eco-tourism D. Hydropower generation for local energy
needs E. Water source for irrigation
3.
Harvested fish and vegetables may be
distributed free of charge to residents or sold in public markets as determined
by the LGU.
SECTION 8. MONITORING AND EVALUATION The LGU shall create a Barangay Man-Made Lake Management Committee to
monitor, evaluate, and report on the implementation and operations of the
lakes. The committee shall include representatives from the following:
1.
Municipal/City Engineering Office
2.
Municipal/City Agriculture Office
3.
Environmental Management Office
4.
Participating NGOs, CSOs, or cooperatives
5.
Community representatives
SECTION 9. PENALTIES Any person or entity found violating any provisions of this ordinance
or causing damage to the man-made lakes shall be subject to the following
penalties:
1.
A fine of not less than PHP 5,000 and/or
imprisonment of up to 30 days, subject to the discretion of the court.
2.
Community service related to the
rehabilitation of the man-made lake.
SECTION 10. EFFECTIVITY This ordinance shall take effect upon its approval and publication in a
local newspaper or in any conspicuous places within the municipality/city.
