AN ORDINANCE TO CREATE AN INTEGRATED COMMUNITY SERVICE SYSTEM

Be it ordained by the Sangguniang Bayan/Panlungsod of ___________ in session assembled:

SECTION 1. Title. This ordinance shall be known as the "Integrated Community Service System Ordinance."

SECTION 2. Purpose. This ordinance establishes an Integrated Community Service System (ICSO) within the City/Municipality of ___________ to provide an alternative sentencing option for minor offenders, alleviate jail congestion, and promote rehabilitation through meaningful service to the community.

SECTION 3. Scope and Applicability. This ordinance shall apply exclusively within the jurisdiction of the City/Municipality of ___________.

SECTION 4. Creation of the Integrated Community Service Office (ICSO). An Integrated Community Service Office (ICSO) is hereby created to coordinate, monitor, and evaluate community service assignments.

SECTION 5. Authority to Assign Community Service. Only the local judge or the Mayor shall be authorized to order the assignment of an offender to a community service project or activity, as an alternative to incarceration or as part of conditional release.

SECTION 6. Prioritization of Community Service Assignments. Community service assignments shall be prioritized as follows:

1.   First Priority: All departments and offices of the city/municipality.

2.   Second Priority: Branches and local offices of National Government Agencies (NGAs), Government-Owned and Controlled Corporations (GOCCs), State Universities and Colleges (SUCs), and Government Financial Institutions (GFIs).

o   This includes the Department of Education (DEPED) and the Department of Health (DOH) for assignments as teachers or health service assistants.

o   Environmental assignments under the Department of Environment and Natural Resources (DENR) and the Biodiversity Management Bureau (BMB) shall be prioritized.

3.   Third Priority: Local units of the Armed Forces of the Philippines (AFP), the Philippine National Police (PNP), and the Philippine Coast Guard (PCG).

4.   Fourth Priority: Non-Governmental Organizations (NGOs), People’s Organizations (POs), charitable organizations, and nonprofit organizations.

SECTION 7. Duration of Community Service. The duration of the community service shall be determined by the local judge or mayor, considering the nature of the offense and the offender's capacity for service.

SECTION 8. Certificate of Completion. Upon satisfactory completion of the assigned community service, the ICSO shall issue a certificate of completion, which the assignee shall submit to the local judge or mayor.

SECTION 9. Support for Jail Decongestion. The ICSO may be used by judges to facilitate the conditional release or early release of prisoners as a measure to decongest jails in compliance with human rights standards.

SECTION 10. Use of Community Service for Minor Offenses. The mayor may assign violators of minor offenses such as littering, jaywalking, or other local ordinance violations to community service instead of imposing fines or jail time.

SECTION 11. Use of Community Service for Drug Offenders. The PNP and the Philippine Drug Enforcement Agency (PDEA) may recommend minor drug offenders for community service as part of rehabilitation and reintegration programs.

SECTION 12. Barangay Recommendations. Barangay chairpersons may recommend their local residents for community service assignments under the ICSO.

SECTION 13. Funding. The City/Municipality of ___________ shall allocate sufficient funds for the establishment and operation of the ICSO.

SECTION 14. Monitoring and Reporting. The ICSO shall submit periodic reports to the Office of the Mayor and the Sangguniang Bayan/Panlungsod on the implementation of the program.

SECTION 15. Implementing Rules and Regulations. The ICSO shall draft the necessary implementing rules and regulations for the effective implementation of this ordinance.

SECTION 16. Effectivity. This ordinance shall take effect upon approval and publication in accordance with applicable laws.
